The Uber and Lyft ridesharing apps are newly approved for use outside of New York City. While this can offer many conveniences (no more waiting in the freezing cold for a cab!), users should be informed and prepared in the unfortunate event that something goes wrong.

AM I PROTECTED AS A PASSENGER IN AN UBER OR LYFT ACCIDENT?
Uber and Lyft Companies are expanding at a rapid pace. Because of the convenience they provide, they have become a popular means of transportation for many people around the world. In fact, the Uber and Lyft companies have changed the world’s transportation options.
If you are a frequent Uber or Lyft passenger, it is important to be aware of how you are protected in case of an accident. Being informed of your rights and how you’re protected may give you a sense of security when you use their services.
Your Protection as an Uber or Lyft Passenger
Most personal auto insurance companies deny claims against ridesharing policies. If you are injured in an Uber or Lyft accident and try to make an accident claim against the driver’s policy, the insurance company will most likely deny your claim. As a protection, Uber and Lyft have policies to cover the damages the insurance company may not cover. Both Lyft and Uber have liability insurance coverage of up to $1 million dollars for their passeng

UBER’S ONE MILLION DOLLAR INSURANCE POLICY
If you have been seriously injured in an accident involving an Uber vehicle, you may be able to take advantage of Uber’s one-million-dollar insurance policy. However, it is important to understand that there are different rules regarding the policy as it relates to drivers, passengers and third parties.
Uber, Lyft and other ridesharing companies that use an app as a means of communication with riders and drivers, are not subject to the same rules and regulations as taxi companies. The app is a convenient and fast way of connecting a person with another person who can give them a ride to their destination. Part of the price paid for an Uber ride includes a fee that goes toward driver background checks, driver safety education and motor vehicle screening. However, Uber drivers are not employees of Uber. They are independent contractors, and this presents a problem for injured riders since companies are only liable for the actions of their employees. Read more.. https://goo.gl/GGR7KV

WHAT IS THE DIFFERENCE BETWEEN UBER CAR ACCIDENTS AND OTHER CAR ACCIDENTS?
Being in an Uber accident is different than being in other car accidents in the following ways:
Uber drivers are independent contractors, not Uber employees. If you were a passenger in an Uber car during an accident, you may be entitled to compensation by both the driver’s insurance policy and the company’s additional $1 million per ride policy.
Since Uber drivers are independent contractors and not Uber employees, it is difficult for passengers, pedestrians and other drivers to make complaints and claims with Uber in the event of an accident.

UBER AND LYFT ACCIDENTS: WHAT YOU NEED TO KNOW
Rideshare companies such as Uber and Lyft offer a relatively new method of transportation that is making it easier and less expensive.
Accidents involving ridesharing services like Uber and Lyft differ from other accidents. This is because in those cases, drivers are not considered employees of the ridesharing company. Rather, they are independent contractors. This creates difficulty when determining liability, and may give ridesharing companies the ability to easily deny an injury claim.
A majority of Uber and Lyft drivers are regular people who are required to have a standard driver’s license and personal insurance. Most drivers have no training in specific ride-sharing transportation skills. Additionally, ridesharing services require drivers to constantly use and check their phones, which creates the additional risk of distracted driving. Dozens of Uber and Lyft accidents have been traced back to distracted driving, texting and other forms of driver negligence.

THE TOP 7 CAUSES OF UBER ACCIDENTS
Uber is becoming increasingly popular. However, with its growing popularity, the frequency of Uber accidents is also on the rise. Many factors are responsible for this. Here is a list of the top seven causes of Uber accidents:
Distracted driving:
Talking with passengers, reaching out for something, etc., can distract a driver’s attention and heighten the risk of accidents.
Speeding while driving:
Uber drivers are considered common carriers. They may decide that speeding is the way to meet targets set by their supervisors. This phenomenon increases the risk of accidents.
Fatigue:
Uber drivers usually drive for many hours. This makes them tired, sleepy and accident-prone. It has been reported that driver fatigue is as dangerous as driving while intoxicated or driving under the influence.

WHAT HAPPENS IF AN UBER DRIVER HITS A PEDESTRIAN?
Have you been injured after being hit by an Uber driver while crossing an intersection or sidewalk? You have the right to file a claim against the driver.
Your Uber accident claim would proceed just like any car accident claim. To recover compensation for your injuries, you may file a claim with the driver’s auto insurance company. If the driver’s personal auto insurance company denies liability or refuses to pay for your injuries, you have the option to recover damages under Uber’s liability policy coverage. However, Uber’s liability coverage does not always provide help to those who have been injured. This is because Uber drivers are independent contractors and are not regulated in the same way taxi drivers are. In the majority of cases where an Uber driver causes an accident, it is the driver who is solely responsible.
